's going to be cold with some wind. that's coming up. >>> a san jose firefighter is recovering after a ceiling collapsed on him as he was fighting a three-alarm fire. it broke out around 8:00 last night. the flames raced through four apartments and damaged two others. a water logged ceiling broke loose and fell on the 16-year veteran. >> he was injured by a piece of large sheetrock, a ceiling that had fallen in when he was in the stairwell. so it had fallen from a considerable height. >> the firefighter was rushed to a nearby hospital with a concussion and fractured vertebrae. officials believe the fire was accidental. >>> memorial services will be held tomorrow for a young man who was shot and killed last week in apattempted carjacking in san jose. 22-year-old rory park was killed by two armed robbers who went on a crime spree in san jose on november 16. they are accused of murder, robbing four east san jose businesses, and having a shootout with police that left one officer hurt. jonathan willbanks is in custody. a donation fund has been set up for the victim's burial costs. >>> po

first thought. he was hurt while battling appear apartment fire in san jose and he remains in the hospital this morning. the damage was done at the apartment complex on willowleaf road. christie smith joins us with the latest on the fire captain's condition. good morning, christie ir. >> reporter: good morning to you. i finally spoke with a fire captain on scene. he said a chance to speak to that injured firefighter and he's still in good spirits, still feeling some pain, though. he was injured when a section of ceiling collapsed on him and he was actually trapped under that for just a little while. there is still a crew here on fire watch this morning. there was some concern still about the stability of the burned building. it was burned so badly and they sprayed so much water on it, that's where the concern is coming from. it started around 8:30 last night at this townhome complex on willowleaf drive. it took about three hours for firefighters to knock the flames down. when they arrived, they say flames were pouring through the roof and spreading through the attic. 18 peo

on this day in 2009 gathered tonight in san jose. they wanted to remember him and to demand a trial. nbc bay area's kimberly tere is at frost elementary school with a look at where the case stands now. >> reporter: blocks from where the killing happened and despite arrests made three years ago, the case is yet to go to trial. >> we want justice for michael. that's what he serves and that's what we are here for. as a family, we're not going to stop fighting for that. michael deserves it and we are going to get it. >> reporter: michael russell's family hosted a vigil at this elementary school the last three years. on november 10th, 2009, he was stabbed to death in the backyard of his home. >> i remember it like it happened yesterday. >> reporter: soon after the killing, police arrested two suspects in the case, both classmates of the victim. randy thompson 16 and jay williams 15 at the time of the killing and both are charged as adults. while the hearing was two with years ago, the trial is yet to begin because of numerous continuances. >> we want to do whatever we can to push this forward. >>

at sacred heart community center in san jose with some people in need getting some help. good morning. >> reporter: good morning to you, jon. the volunteers are finally starting to show up this morning and, boy, it is cold and wet out here. some of these folks have actually been waiting in line for up to 18 hours just to register for a chance at holiday food and toys. i spoke with one man this morning who told me he is still out of work, there are kids in the home and that's why he is here at sacred heart community service where about 200 people are in line. there are tents out here, some just under umbrellas and blankets. the poverty rate, i spoke with one gentleman and he said for the county it's 10.6%. they expect to distribute about 7,000 food boxes between thanksgiving and christmas. right now, though, they could use some help with cash or food. >> so we hope to have all the food in here by this coming friday. right now we have four turkeys in the freezer. so you do the math on that one. there's a lot of work to be able to do. >> reporter: registration this morning starts somewhe

victory for minimum wage earners here in san jose. let's talk about measure "d." that's the minimum wage measure in san s leading with the majority of precincts reporting. with the presumed passage of measure d, the hourly rate will go up $2 an hour from the state rate of $8 to $10 an hour. those for measure d argue this was a moral necessity given how expensive it is to live in silicon valley. others say it will hurt the market as higher wages force companies to cut back on hiring. measure e. that's the measure. around 60% have said no. measure e would have allowed san jose's two card rooms to add more gaming tables resulting in more tax revenue for the city. proponents saying as much as $5 million more a year for things like plisholice, fire and libra. opponents argue card rooms would have added more crime. coming up, reaction from mayor chuck read not only about those two measures but about council woman rose herrera winning last night. that story coming up. meantime, reporting live here in san jose, bob rodell "today in the bay." >>> let's get the weather out there. the reality of fa

jose's fame miss turkey trot -- famous turkey trot. we are in san jose in the middle of everything and i'm looking over your shoulder, this is one of the biggest thanksgiving day races in the country. >> reporter: yeah, that's right, and the costume contest is about to get underway. you can see there's some great costumes. there's indiana jones, we have super mario brothers, a robot. and even pacman, and it's going to be a lot of fun, judging is about to start, but in the next 45 minutes, the first race will begin. now, this is video of last year's turkey trot. it's the second largest race of its kind on thanksgiving day. a majority are participating in the 5 and 10 k. organizers have extended the deadline until 8:00 a.m., and we started seeing a lot more people starting to show up, and getting warmed up to race. >> i feel it's cool, like it's intimidated, but the fact that there are so many people you don't know, it's encouraging you to -- >> are you excited about burning calories? >> yeah, yeah. more excited about eating afterwards. >> reporter: all the registration funds raised

in san jose, outside mayor chuck reed's house with the result of the races and some reaction from the mayor himself. >> reporter: good morning. let's first go over those numbers. incumbent district eight council woman rose herrera did beat out challenger jimmy nguyen. she took over 50% of the vote. mayor chuck reed of san jose's with us this morning. she's considered an ally of yours, fiscal reform. what message are you taking from this? >> it's certainly a big win for fiscal reforms. because governor employee unions launched an all-out attack. trying to reverse what the voter's approved in june. the pension reform. this is a big day for the people of san jose and beginning to restore services as we save money on all these pension reforms. >> measure e would allow casinos to add card tables. that was defeated. a majority of voters said no. around 40% said yes. you did have a neutral stance. but personally, you did vote for it. your argument being, it would add tax revenue. opponents saying it's going to add too much crime. what's your response? >> we could use additional revenues.

and the update on the investigation there to the case. >> reporter: yeah. i checked in with the san jose police department spokesperson for the update on this case. they are still search for a second suspect or at least that's what was happening all this week as they released a sketch on that expect now hee mailed me back and said per the homicide unit we aren't confirming or denying any new information. that came after i asked them if an arrest had been made. >> the man was shot and killed last week. one of the suspects a 26-year- old was in court wednesday. police say he and another man robbed four businesses, murdered a 22-year-old in a carjacking and participated in a shoot out with two officers one of the officers was hit and taken to the hospital with minor injuries. willbanks was arrested the next morning. officers released a sketch of the second suspect, a 20,000- dollar reward is being offered for his arrest. the funeral for the victim is being held this morning at 11. we will continue to talk to police and ask them about updates on that second suspect and bring you new information on
